Here i am, planting a fake soul gem for my shady boss, and theres a desk full of expensive soul gems sitting in front of me when i arrive. If no one saw me steal the gems are they gonna figure it out? i don't know if i even want to because it seems kinda gamy, but i am curious.

The thing to remember is that the "stolen item" tag is infectious. If you steal a common soulgem from Galbedir, it'll be marked stolen. If you have other common soulgems already or collect more while holding that one, they'll all be marked stolen, too. even if you purchased them. Now, this only really matters if you ever use those soulgems with Galbedir (either barter or enchanting) or if you get your stolen stuff confiscated by the cops. Otherwise, it's fine!
